In some ways, "hemp-derived" is a simple term. It refers to any product that is created from hemp plants. 

That could mean CBD. It could mean THCa flower. And it could even mean Delta-9 THC. 

This is where things get a little complicated. All of these products, including THCa, can technically be made from either cannabis plants or hemp plants. But only those made from hemp are federally legal.

So what differentiates hemp? And how can you tell if your THCa is hemp-derived? 

The Legal Status of Hemp-Derived Products

Hemp has been grown around the world for thousands of years. But it was only somewhat recently that the US legalized it at the federal level.

Federal Law: The 2018 Farm Bill

In 2018, the federal government passed a law legalizing hemp. Under the 2018 Farm Bill, legal hemp was defined as plants containing less than 0.3% THC by dry weight. 

Hemp naturally contains hundreds of compounds, including dozens of cannabinoids. Perhaps the most important of hemp's cannabinoid content is cannabidiol, or CBD.

CBD is a potent compound in its own right. Research suggests it has many potential health benefits, from boosting mood to supporting heart health and much more.¹

However, CBD can also be converted into other cannabinoids, like THC. Under current federal law, THC is considered a controlled substance — unless it's derived from hemp, such as by converting hemp-derived CBD. THC products created in this manner are considered hemp-derived, and are therefore considered legal under federal law. (Local laws may vary.)

Tetrahydrocannabinolic Acid (THCa)

Tetrahydrocannabinolic acid, or THCa, is a precursor to THC. Its chemical structure is very similar to THC. The only difference is that THCa has an extra carboxyl group. 

Unlike THC, THCa is not psychoactive, and therefore has no psychoactive effects. However, when heated, a process called decarboxylation converts THCa into THC. That THC is chemically identical to the THC naturally produced in cannabis, and therefore has all the psychoactive effects you'd expect.

THCa is naturally produced by hemp plants. THCa flower, therefore, can be harvested from hemp plants.²

As we mentioned, THCa flower in its raw form is not psychoactive. If you consume raw THCa, you won't get high. 

Why would you do that? Well, research suggests that THCa has plenty of its own potential health benefits. For example, studies on animals have found that it has anti-nausea and neuroprotective effects.³

Legality of THCa Products

As we explained, products created from legal hemp are also considered legal. That means THCa flower harvested from hemp plants are legal, as long as they abide by the 0.3% THC limit. 

Of course, heating the THCa, as happens during smoking, will convert it into THC. Some people consider this a loophole in the law.⁴ For that reason, some states have moved to ban THCa.

Additionally, in December 2025, US lawmakers voted to adjust the legal definition of hemp. They changed the 0.3% legal threshold to include all types of THC, not just Delta-9 THC. Theoretically, this would close the legal loophole and make THCa illegal at the federal level again.

That said, this new law isn't set to take effect until November 2026, and some lawmakers have already filed legislation to protect legal THCa products.

Until that law actually comes into effect, which it may never do, THCa remains federally legal.
